Epic Games has asked the U.S. District Court for the Northern District of California to force Apple to conduct a timely review and approve an application to return the Fortnite game to the App Store if it qualifies.

After Epic’s announcement to block Fortnite’s return to the App Store, however, Apple sent the video game developer a letter saying it would take no action on Epic’s application “until the Ninth Circuit rules on the pending request for a partial stay of the new ban.” Apple also ordered Epic to resubmit its application for the European market separately from its U.S. application.

In response, Epic said Apple’s proposal to offer two different versions of Fortnite for different markets violates the company’s own rules, which prohibit developers from providing multiple versions of the same app. “This is not the standard that Apple requires of other developers, and it prevents us from releasing updates for the EU and US,” the company said.
Epic also emphasized that their statement does not violate any rules. In its commentary, the developer said Apple’s denial is “a clear retaliation against Epic for challenging Apple’s anti-competitive behavior and exposing its lies in court,” leading to an injunction and contempt order.

The company sent a letter notifying the company that they will take no action on the processing of the application until the Ninth Circuit Court issues a partial stay of the injunction. Epic considers this to be a violation of the injunction and has already filed a complaint to that effect.
