Nintendo sues Genki for unofficial Switch 2 mockups

Nintendo has filed a lawsuit against Genki, an accessory manufacturer known in the gamer community for its unconventional and advanced solutions for Switch. In a complaint filed late last week, Nintendo accuses Genki of trademark infringement, unfair competition, and false advertising.

The crux of the complaint is that Genki showed accessories at CES 2025 in January that were supposedly compatible with the yet-to-be-announced Switch 2 console. The company also used Nintendo logos and branded elements without permission. Genki also posted a 3D rendering video of the console online without having official access to the device.

Nintendo: Genki misled consumers
Although Genki later claimed on social media that it did not possess a “black market” console and was only basing its claims on leaks, Nintendo considers its claims to be contradictory. The lawsuit states that the company continued to promote its products as compatible with Switch 2, misleading consumers.

After the Switch 2 was officially announced on January 16, Genki held its own presentation, a “Genki Direct” timed to coincide with the Nintendo Direct. This, according to Nintendo, added to the confusion and hurt potential sales of the original accessories.

In an official statement, Genki said it is “taking the lawsuit seriously and is working with lawyers to respond intelligently.” In doing so, the company emphasized its independence and dedication to the gamer community:

When is Switch 2 coming out?
The wait for Switch 2 has been years in the making, with rumors and leaks popping up since 2021. Nintendo began taking pre-orders for the new console in April, and sales are scheduled to start on June 5, 2025.
